Florida allows remote and mail-away closings for residential real estate transactions, making it possible for FSBO sellers to complete their sale without being physically present at the closing table. What Is a Remote Closing?

A remote closing (sometimes called a "mail-away" closing) allows the seller to sign closing documents outside the title company or attorney's office. The documents are prepared, sent to the seller, signed before a notary, and returned for recording.

There are two primary formats:

  • Mail-away closing: Documents are shipped via overnight courier, signed before a local notary, and returned
  • Remote Online Notarization (RON): Documents are signed and notarized via secure video conference

How Remote Closing Works for FSBO Sellers

Step 1: Contract and Title Work

The process begins the same as an in-person closing. Once you have a signed purchase agreement, your attorney or title company performs the title search, clears any issues, and prepares the closing documents.

Step 2: Document Preparation and Delivery

The closing package (deed, affidavit of title, settlement statement, title insurance documents) is prepared and sent to you via secure overnight delivery or digital platform.

Step 3: Signing Before a Notary

You sign the documents before a notary public in your location. For mail-away closings, you visit any local notary. For RON closings, you connect via video with a Florida-certified remote notary.

Step 4: Return and Recording

Signed documents are returned to the closing agent, who verifies everything, disburses funds, and records the deed with the county.

Remote Online Notarization (RON) in Florida

Florida was one of the first states to authorize Remote Online Notarization under Florida Statute 117.265. RON allows:

  • Video conference notarization from anywhere in the world
  • Multi-factor identity verification
  • Tamper-evident digital recording of the signing session
  • Electronic signatures with full legal validity
