Extraordinary Circumstances Parental Rights Exception

Definition: The legal standard applied when a non-parent seeks custody or timesharing of a child over the objection of a fit parent. Extraordinary circumstances must be demonstrated to overcome the constitutional presumption that a fit parent's decisions regarding their child are in the child's best interest.

FL Extraordinary Circumstances: Parental Rights

FL extraordinary circumstances: allows non-parent custody/visitation over fit parent’s objection. Troxel v. Granville (2000): fit parent’s decisions get special weight. Very high standard: parent unfit or child harmed. Findings: parental unfitness, established custodial relationship, harm to child, and consent withdrawal. Section 752.011: grandparent visitation. Process: petition, clear/convincing evidence, guardian ad litem, hearing, and order. Parent: constitutional right to direct upbringing.
