FL Exemplary (Punitive) Damages

FL exemplary damages (Section 768.72): punish + deter. Awarded for: intentional misconduct (actual knowledge + intentionally pursued) or gross negligence (conscious disregard). Caps (Section 768.73): general (3x compensatory or $500K), no cap for unreasonable financial gain or specific intent to harm. Procedure: NO initial complaint; motion to amend + proffer of evidence + court ruling; may bifurcate trial. Court: specific findings required.
