Ex Parte Hearing One Sided Court Proceeding

Definition: A court proceeding in which only one party appears and presents evidence to the judge, without the opposing party being present or having received notice. Ex parte proceedings are exceptional and are permitted only when immediate relief is necessary to prevent irreparable harm.

FL Ex Parte Hearing

FL ex parte hearing: one party appears without other present. Limited: TRO (Rule 1.610: immediate irreparable harm), domestic violence (Section 741.30), prejudgment writs, and property protection. Requirements: urgency, sworn affidavit, narrowly tailored, temporary, and notice (serve promptly). Bond may be required. Opposing rights: notice, full hearing (10-15 days for TRO), motion to dissolve, and damages from bond if wrongful. Exception, not the rule.
