Cross-Collateralization of Properties

Definition: A lending arrangement in which multiple properties secure a single mortgage obligation, or in which a single property secures multiple obligations from the same lender. Gives the lender security across the borrower's entire portfolio.

FL Cross-Collateralization

FL cross-collateralization: one collateral secures multiple loans, or multiple properties secure one loan. Section 697.02: governs mortgages. Dragnet clauses: property secures all current + future debts. Benefits lender (lower risk); risks borrower (default on one = foreclosure on all). Impact: multiple properties at risk, difficulty selling (lender consent), reduced borrowing, and complexity. Removal: partial release provision, refinancing, payoff, and negotiation. Negotiate partial release at origination.
