Vesting of Rights Property Development

Definition: The point at which a property owner's development rights become legally protected against subsequent changes to zoning or land use regulations. Once rights are vested, the government cannot retroactively apply new regulations to prevent the approved development.

Florida Vesting Rights for Property Developers

FL vesting rights lock in development rules. Protection from: rezoning, building code changes, and plan changes. Not absolute (public health/safety). Development agreements (Section 163.3220-163.3243): strongest vesting (binding contract, 10-30 years, describes development, identifies laws, developer obligations). Both benefit: developer gets certainty; government gets infrastructure. Disputes: common law test, statutory framework (Section 163.3167(8)), and FL Constitution (due process, takings). Developer bears burden.
