In Camera Review in Florida Courts
In camera review is a private judicial examination of evidence that allows a Florida judge to evaluate sensitive materials before deciding whether they should be disclosed to the parties or admitted at trial. This procedure balances the competing interests of open discovery and the protection of privileged, confidential, or constitutionally protected information.
Purpose and Function
In camera review serves as a judicial gatekeeping function:
- For producing parties: Prevents premature disclosure of legitimately privileged information (disclosure may permanently waive the privilege)
- For requesting parties: Provides oversight to prevent abuse of privilege claims as blanket discovery objections
- For the court: Creates a factual record for the ruling, allowing informed decisions based on actual document review

This allows appellate courts to review the same documents when evaluating whether the trial court’s privilege ruling was correct. In Florida, discovery orders are reviewable by petition for certiorari to the district court of appeal.
