Discussion at the American College of Trust and Estate Counsel.

Jeffrey S. Goethe led a discussion on Trust Protectors at the Fall meeting of the American College of Trust and Estate Counsel in Charleston, South Carolina. The presentation was made to the College's Asset Protection Committee. The committee engaged in a lively debate about the nature of a trust protector, the duties of a trust protector, compensation, and language used in trusts to help clients with planning needs that include a trust protector. The use of a trust protector in a trust is intended to help clients with documents that provide for flexibility, respect for the client's wishes and intentions, and the ability to address unexpected changes during the client's lifetime and after their death. Florida law permits trust protectors, but the language included in a trust is very important.
